[WSBARP] Eviction Legislation Forum II: recording and materials

Thanks to everyone who attended yesterday’s forum, and most especially to our guests Ashley Duckworth and Mark Morzol from TacomaProBono Community Lawyers, and Kyle Woodring of the Rental Housing Association of Washington. 

Kyle has shared much information and links about the legislation, which are found below. The public hearing process starts Tuesday morning January 21, 2021 at 10:30am, so anyone who wants to weigh in on this problematic bill should not delay.

Please note Kyle's email below represents the views of the RHAWA. I share it as part of the discussion, and not as an endorsement of any kind. 

In addition to concerns identified in our first forum, yesterday’s session made clear the proposed legislation amounts to a wholesale rewriting of the RLTA, which was recently overhauled, and includes controversial components that have not found consensus in the past.

Members of the ADR section left the session with greatly elevated concerns about the bill’s mediation component, and generally feel the provision should be removed entirely. 

As written before, many of us are pulling together urgently with the intention of influencing development of the legislation, though we may not agree on particular points. Please write me if you are in a position to be part of this effort, or if you feel a third forum would be productive.

Rent Control Bill SB 5139 Scheduled for Public Hearing

SB 5139 will prohibit a housing provider from increasing rent or other charges for the first 6 months after the end of the Governor’s emergency eviction ban. 

After the first 6 months expire, housing providers are then limited to only increasing rent by 3% over the previous year’s consumer price index, for a subsequent 6 months, based on the rental rate as it was on March 1, 2020. 

SB 5139 would seek to aggressively limit rent increases in a period where lawmakers have decided to prevent the enforcement of rental payments. Small housing providers are faced with a total lack of protections for large increases in property taxes, utility costs, and potential devastation of their credit with lenders.

Rent control has proven to be a terrible policy for both housing providers, city planners and tenants alike. The policy creates perverse incentives, shadow markets, and punishes maintenance and reinvestment in residences. It locks tenants into their rental properties forcing people to commute farther and farther to their places of employment, and allows more affluent renters to pay reduced rent rates, blocking the units from being available to those in need.
