[WSBARP] Turning Multi family units into zero lot line townhomes

Kaitlyn:

Zero lot line town homes are a subdivision processed by the City or County similar to a plat.  Each jurisdiction has their own rules.  Some jurisdictions do not have ordinances for zero lot lines.  Some jurisdictions only allow them in certain zoning areas.  If a town home subdivision is completed then you need covenants that cover the maintenance of the units.

If a subdivision cannot be done or if the process is too complicated then you can divide the units by a condominium.  Most jurisdictions will allow “airspace” condominiums where the condominium map looks similar to a subdivision map. Some smaller jurisdictions have stated that airspace condominiums cannot be done because it is an illegal subdivision unless you do a binding site plan. RCW 64.90 now states that condominiums are not subject to RCW 58.17 (subdivision code).  That should eliminate the objection of small jurisdictions to airspace condominiums.

Since your client is doing a conversion of an existing rental then the requirements under RCW 64.90 for conversions have to be met, including water instrusion inspections.
