[WSBAPT] Wrong name on deed

I agree that including both names in the indexing information at the head of the deed is an important, well-advised step.

This is analogous to a situation where a deed intended to convey title to Property A improperly references the parcel number for Property B.  In the correction deed, the parcel numbers for both Property A and Property B should appear in the indexing information.  Otherwise, the Assessor’s records will likely reflect a conveyance of title to Property B.  (Also, in this case, I recommend using a brand-new cover page for the corrected deed.)

Can be done with one deed—just recite “Jane Jones, who received title as Jane Junes....”

I also include both the misspelled name and the correctly spelled name in the indexing information at the head of the deed, hoping that the recorder will index it under both. I think that helps maintain chain of title, though it’s something I just started doing some years ago and haven’t any case law to back it up.

My client's name is spelled incorrectly on several deeds (a "u" instead of an "o"). The error was not caught by the notary or title company.

He and his wife now want to transfer the property to their living trust. Do I need to file a corrective deed first, or can this be addressed in the new deed ("correct name AKA wrong name hereby deeds to correct name as trustee")?
