Or this could be handled in the same deed without the need for a community property agreement. Consider conveying title to "John and Mary as joint tenants with right of survivorship as to a 2/3 interest and Daughter as to a 1/3 interest." The name of the Grantees might be a bit long, but it will still be shorter than the language contained in a community property agreement.

I am not sure I know the answer to your question, but believe that adding daughter to title would sever the joint tenancy. Depending on what exactly they are trying to accomplish, I would consider if adding daughter to title to simply indicate H&W a married couple as to 2/3 and daughter as to 1/3, then have a community property agreement that provides for at least this property to be community property and pass to the survivor.

Hi Listmates,
Can a husband and wife who hold title as joint tenants with right of survivorship add their daughter as a tenant in common with a 1/3 interest, while retaining their JTWROS between themselves for the remaining 2/3?
Will this structure work, or would adding the daughter automatically sever the JTWROS and convert all interests to tenants in common? My research is yielding mixed results.
