[WSBARP] Statute of Limitations on Insurance Claims

Generally, the terms of the client's insurance contract should control. Under RCW 48.18.200, an insurance contract cannot limit "a right of action against the insurer to a period of less than one year from the time when the cause of action accrues. In contracts of property insurance, or of marine and transportation insurance, such limitation shall not be to a period of less than one year from the date of the loss."
In the absence of any tolling agreement, the absolute latest deadline by which a claim must be made against another party is governed by RCW 4.16 (statutes of limitation).

Subject: [WSBARP] Statute of Limitations on Insurance Claims

Hi, Listmates.
I'm helping a client make a claim under an insurance policy-their business was damaged by a neighboring business springing a leak and flooding into their store.
What if any statutes of limitation or administrative rules in WA affect the time in which a claim can be made under an insurance policy in WA? I don't think we have a problem because the events happened within the last year, but I'd like to make sure.

Best Regards,

Dave Culbertson
