[WSBARP] Residential Lease Security Deposit - Can it be applied to unpaid rent?

Listmates:

 

Tenant evicted for non-payment of rent.  No judgment for past due rent
sought or obtained.  The past due rent far exceeds the security deposit.  I
looked at the security deposit provisions in 59.18 but did not see anything
prohibiting retention for unpaid rent, provided the proper retention notice
is timely given.  However, some where in the back of my mind, I didn't think
the security deposit could be withheld and applied to unpaid rent.  The
lease, appears, to allow for the landlord to retain the deposit for past due
rent.  Your thoughts?
