[WSBARP] Speeding Easement Users

The answer might be found in the easement agreement itself. I suspect that it is a nonexclusive easement for access without any particular restrictions as to what the servient estate may do within the easement area. In my view, installing speed bumps would not impair the neighbors reasonable use of the easement area. In my view, speeding is not a reasonable use.

Subject: [WSBARP] Speeding Easement Users

Listmates:

Common problem with questions on how to solve. Neighbor, a renter, accesses his home using an easement through clients property. Neighbor likes to speed down the drive. Client wants to know if speed signs can be placed, which I believe they can, but in reality will not slow down anyone. Can speed bumps be placed in the easement? I believe I read a case where speed bumps were deemed an unreasonable interference with the dominant owners use of the easement; but maybe because they were very large. What experiences have you had in this area?
