Mark,      The timing of the quit claim deed raises all sorts of suspicions and I think a court would look at it with a jaundiced eye.       The first question is competency. There are several questions that should have been asked to make that determination. The second is undue influence. Was the grantor in a hospital? Who are the persons who had contact with the grantor in the 24 hours or so before death? What do the medical records show? What does the notary say? Was the grantee a natural beneficiary of the grantors wishes? Why did the grantor sign at the last minute? How consistent is the grant with the grantor's will? Did it cause someone to be disinherited? Did the grantor make a request of someone to bring a deed to him/her or did the motivation come from the grantee? Who drafted the deed? Also, examine the deed. Is there a proper legal description? While there is a case that just recently came down from the COA saying a parcel number is sufficient, that case flies in face of decades of precedent and had a lot of attorneys and title people shaking their heads.       There are a lot of questions that need to be asked. Getting to the medical records is also going to be an issue.

We need  more information on the situation at time of signing; and what was
the purpose of the deed?  What was the Grantor's condition  when signing.
Are their disgruntled heirs involved?  Are there issues of undue influence
or the competency of the Grantor?

Putting aside Jeff's serious issues about capacity and undue influence, i.e.
assuming the deed was valid as of Friday, I see no problem with recording on
Monday after death.  If the deed was not recorded, it would still be valid
against all parties with knowledge.  Recording just gives notice to the
world of the transfer.

A deed is only effective upon delivery. Delivery is presumed if the grantee submits the deed for recording. Delivery I am pretty sure can also be accomplished if the Grantor delivers the deed to a third party (such as an escrow, or grantor's lawyer) with unconditional instructions to deliver it to the grantee. I would be examining what happened to the deed between execution and recording-who had it and when, and how did they get it, and who recorded it.

The purpose of the deed was to convert a tenancy in common to a joint tenancy with right of survivorship.  Grantors and Grantees are the same - they just changed the way in which they held title.

Grantor was in the last stages of battling cancer.  No known issues of competency or undue influence.  No known disgruntled heirs.

the purpose of the deed?  What was the Grantor's condition  when signing.

Our client recorded a quit claim deed to transfer the property from two individuals to a married couple and where the wife took the husband's last name.

Although the Deed was properly recorded and shows up when conducting a records search, the Assessor's office did not update the wife's last name with their records they just added her middle name as her last name.

Is there an easy fix to correct this? Or do we need to record another deed?

I recommend recording a corrected deed.  The recording would be exempt from excise tax under WAC 458-61A-217 (new affidavit required).

If the deed itself is correct and the county just did not update the
owner/taxpayer accurately you can ask them to fix it., If you email
kingcountytreasurer at kingcounty.gov with the issue they usually say it will
take 3-4 weeks to correct. I email them the facts and request for the
update and attached the relevant documents

I had this happen in Snohomish County when the Assessor refused to remove the deceased joint tenants after their death certificates were recorded.  I finally wrote the Civil Deputy Prosecutor who took care of it.

If the deed itself is correct and the county just did not update the owner/taxpayer accurately you can ask them to fix it., If you email kingcountytreasurer at kingcounty.gov<mailto:kingcountytreasurer at kingcounty.gov> with the issue they usually say it will take 3-4 weeks to correct. I email them the facts and request for the update and attached the relevant documents

Although the Deed was properly recorded and shows up when conducting a records search, the Assessor?s office did not update the wife?s last name with their records they just added her middle name as her last name.
