Jeff,     I would view the BF as a permissive occupier and not a squatter. Generally, I do not see judges making a distinction between the "guest" and the tenant. I would give the guest the notice. In all our UD matters, we always assert, John Doe and Jane Smith, h and w, and all unknown occupants. Invariably someone else is there. Our sheriff will act on orders that have that designation, but I recall that in some counties judges require the other occupants to be named which is a pain to have to do.

Listmates,

 

Tenant allowed her BF to move in without LL's permission.  Tenant is
receiving a 14 day notice to pay or vacate with the required ERPP notice.
BF is receiving a 3 day notice to vacate.  On its face the ERPP notice does
not apply; BF is not on lease.  Should the ERPP notice be given to him
anyway?
