Listmates,      Our office does not do a lot of unlawful detainers,, but I have run across a concern with a case and with others I have observed.       As you are aware, the Summons we have to use has all sorts of contact information for tenants to get help. The email address for help goes to a link for a screening process for the Northwest Justice Project to determine if people are eligible. It seems that a number of people are showing up in court at the initial hearing who have tried to find counsel and are frustrated by the process. It seems that for some reason that online process is not working. I have seen several people who have then called them, and in each instance have been told to go to the hearing, and then call back if they need help.       The effect of this is that the hearings get continued. So instead of the NW Justice project taking a few minutes to screen someone at minimal expense, it costs the landlord a significant amount for the attorney to have to come back to court, and for, possibly, unpaid rent. In my case, it was not a money issue, but two people getting drunk at night and getting into fights, yelling and throwing things, waking everyone else up. So the people in the units now have to put up with this for another week.       I would be interested in hearing about other people's experience. It raises the question as to whether or to what extent this is, or is not, a deliberate strategy.

120 day notice pursuant to 59.18.200(2)(c) may work.  It's provided for in
RCW 59.18.650(2)(f).

Hello Listservers,

 

Got an unusual situation and wanted to solicit your input and ideas.  In a
nutshell, landlord has a low income tenant who is behind on rent and will
not vacate.  Notices (14 Day Pay or Vacate, ERRP Referral, and Repayment
Plan) have already been served.  Landlord has subsequently discovered issued
with building envelope and roof and needs the tenant to vacate to make the
needed repairs.  

 

The property is located in Kirkland and so as best I can tell Kirkland
Municipal Code did not have a mandatory tenant relocation license/ permit
requirements for  landlords to obtain like Seattle does.  

 

Aside from RCW 59.18.650(2)(h) which only permits a Notice to Vacate based
on the building being condemned/ uninhabitable as deemed by a local agency,
are there any other grounds that you can think of to serve a notice to
vacate for repairs / construction/ remodeling?  

 

All ideas and input are welcome!

Listmates, my client owns a steep-slope parcel of raw land zoned "lowrise."
The parcel also includes a significant portion subject to a claim of AP. My
client is new to development and is looking to hire an architect to assist
him with the project.

Valuation of the AP claim requires insight into its impact on the
development potential of the parcel. So the time is now to start working
with an architect (or other qualified professional) on the project.

If you have any recommendations, they would be greatly appreciated!

Listmates, my client owns a steep-slope parcel of raw land zoned "lowrise." The parcel also includes a significant portion subject to a claim of AP. My client is new to development and is looking to hire an architect to assist him with the project.

Valuation of the AP claim requires insight into its impact on the development potential of the parcel. So the time is now to start working with an architect (or other qualified professional) on the project.

If you have any recommendations, they would be greatly appreciated!

We currently use Windstream to manage our phones for our remote offices (6 locations).  There's some ongoing staff mutiny about managing the Windstream systems which ARE clunky, although not ineffective.

Looking for recommendations on other VOIP phone providers that have proven effective; and also looking for feedback on Vonage specifically.

The Uniform Directed Trust Act (RCW 11.98B) replaced the previous RCW 11.98A.030 (Statutory trust advisor), etc.

RCW 11.98B uses the term "trust director."

I see the WA Deskbook on Estate Planning and some trusts created in 2022 still use the term "Independent Trustee."  I see the roles of "Independent Trustee" are equivalent to "trust director", just want to know is it an acceptable practice to use  "Independent Trustee" or other similar terms in a trust agreement rather than "trust director?" or am I missing something?
