Joseph,      Take a look at the receiver statutes. I think that may be what you want. One of the issues you always have is control of the property. In partition actions, there is usually someone that does not want the sale so they fail to fully cooperate. Having a receiver solves that problem. I make sure my court order gives broad power to the receiver.

Sammamish house sits on 2 tax parcels, separately owned.  Both owners want to sell, maximize sale price, with a distribution of proceeds based on their value.

Seems to me simply hiring a real estate agent is insufficient because of the need to value and adjudicate the split of proceeds, and deal with potential other issues that may arise.

Looking for someone who would serve as a referee, akin to one appointed in a partition action, and has that experience, who could consummate the sale, do the valuations and determine the appropriate split of $.

I am not sure of his comfort with value calculation but Allen Sakai in Bellevue is who we use as referee on our partitions.  425 454 2344.  Great attorney but don't tell I said so.

Listmates,  I am wondering if everyone is having a difficult time finding new hires.  Typically when I run an add on the WSBA site for an attorney I at least get responses from the unqualified but willing to learn group.  My ad has been up 3 weeks and ZERO response, except from a current member of the firm that applied to see if the site was functioning.  I have had 4 people read the ad to make sure I was not saying something that was politically incorrect ( as I am prone to do) and all say it is fine.  Anyone else having this issue????
