[WSBARP] SB 5009--Uniform Public Expression Protection Act

Attached is SB 5009 offered as the Uniform Public Expression Protection Act.  Also attached are the comments from the Uniform Laws Committee.

This bill is under consideration in this 2021 Session (well, soon will be).  As written,  a SLAPP motion to dismiss could appear in LUPA appeals as one example or a neighborhood matter where a neighbor complains to the local government about someone as two examples.

I think there should be an exception for "real estate cases" (this term is used in the broadest sense).  Something like this comes to mind:  "this Act does not apply to civil suits or claims brought to establish or declare possessory rights, use of property, recovery of property, quiet title to property or related claims relating to real or personal property."

If you agree, contact your legislators.  If you have better language for an exception, let us all know.
