Kaitlyn is probably going the smart route here. I have obtained them in King and Pierce Counties. In Pierce County if you are going to press for back rent and costs, make sure that you mail a notice to the HJP and DRC prior to filing the summons/complaint to meet the Emergency Order requirements below:

I have had this same question a couple dozen times but I have not even tried to get unpaid rent in the judgment because I didn't want to create any issue for appeal or anything that would make the case more "shaky" than they already are. So, I just reserved those issues of unpaid rent and utilities in the judgment section of the findings of fact and conclusions of law.

I'm curious whether anyone has had success obtaining a judgment for rent under the Evictions Moratorium. I have been having my clients document their attempts to offer tenants a "reasonable repayment plan" under the carve-out in the moratorium, to preserve the ability to treat rent as an enforceable obligation in the future. I now have some clients who have grounds to evict based upon intent to sell, who are also owed rent, and whose tenants ignored requests to enter into a repayment plan. Has anyone tried to incorporate rent as damages into an unlawful detainer action that is otherwise permitted under the moratorium?
