I assume that the garage is not up to code.  Bringing it into compliance may be better than rebuilding it. Current owner has no privity with Agent.  Agent ought to immediately contact their E&O company to have them handle it .  Better to have it on the basis of agency than from when agent owned the home.

Seller’s Agent was the immediate prior owner of Seller’s property, and while owning it the Agent built an addition onto a garage without obtaining the require permits.  Agent then sold the property to the Seller.  Seller than sells to current owner without disclosing the lack of permits on the form 17.  Owner wants to improve the garage.  The County found out about the Agent’s work and said that had to be completely removed and rebuilt with proper permits.  What is the Agent’s liability?  Seller if very old and most likely was not the person filling out the form 17.
