[WSBARP] FED or ejectment?

Client's brother is living with their mother in her home.  Mother gifts
property to client, then dies.  Brother refuses to pay rent or leave.  The
deskbook seems to suggest that FED does not apply, that no notice is really
required, and that the owner can proceed directly with an ejectment
action.  Does that resonate with my fellow listerians?
