Justin,

I've had a client with a similar scenario. Foreign company defendant, registered to do business in Washington. We served the registered agent and obtained an order of default and a default judgment. To collect against the foreign company my client filed a receivership action  in the foreign jurisdiction in order to liquidate the assets of the foreign company to satisfy the default judgment. Worked out pretty well.

Maybe someone can help me on this issue.

We took a default judgment against corp. that does business in WA state. We personally served the registered agent in WA state. Registered agent confirmed that the defendant named was a WA state corp.  We never received any notice of appearance, letters or anything else to dispute that corp. was or was not foreign corp. doing business in WA.  However, it appears the corp. is domiciled in foreign jurisdiction.

Also, the corp. admitted that they were properly served.

Default Judgment is over one year old.

Can we file a motion to change the case caption to include the corp. as a foreign corp. doing business here in WA.

How can we collect against this corp. Thoughts?
