The trustee is supposed to be “neutral”.  If  your client is ready, willing
and able to “cure”, then the trustee MUST cooperate.  If you are trying to
negotiate something less than full payment, then, well, the trustee does
have the right to postpone the sale for good cause and you could try to
convince him to do that.  Trustees have to be careful these days to not
appear to be representing the beneficiary.  I don’t have any pleadings to
share, but you should certainly put the trustee on notice of the risk he is
taking if he doesn’t cooperate in a cure.

Dear Colleagues,

 

I am presented with an unusual and urgent matter.  Client defaulted under
note and deed of trust and the trustee’s sale is set for April 29. Client
wants to reinstate and the trustee and the beneficiary are not responsive to
my proposal.  I have until Monday April 18 (11 days prior to the sale date)
to bring an action to discontinue the trustee’s sale.  Would anyone be
willing to share the necessary pleadings in order to force the
trustee/beneficiary to speak with me to discuss reinstatement. Thank you.
