[WSBARP] Use of Utility Latecomer Agreements by Associations

Chapter 35.91 RCW, MUNICIPAL WATER AND SEWER FACILITIES ACT, allows
municipalities to enter Utility Latecomer Agreements.  There’s no
statutory authorization for water associations organized as nonprofit
corporations or homeowners associations to enter similar agreements, nor
does there appear to be any statutory authorization.  I wonder if anyone
has guidance to share on whether 35.91 RCW’s grant of authority to
municipalities precludes other non municipal entities from using the same
mechanism, or not.
