Good Morning -
I am trying to brainstorm an issue in an ongoing probate matter.
The decedent’s Will left a lake cabin 50/50 to her children B and J. B predeceased and has one child, M.
Neither J nor M want the cabin in their own name for unknown reasons but everyone wants the cabin to stay in the family.
J (86) (beneficiary to 50%) would like to give her 50% to her daughter R (60).
M (45) (beneficiary to 50%) has four children - three adults and a new baby. She is considering giving her half to her daughter L (23). (This seems like a really bad idea.)
They want the Agreement to include that neither can sell their interest in the property without consent of the other.
The plan being discussed is to use money from other estate assets to start an escrow-type account that pays the property expenses for several years.
Does anyone have any suggestions as to how best to handle this or how to structure an Agreement for this type of situation?
