[WSBAPT] Late HOA creditor claim

Hello,

This is a follow-up question to a question I posed to the network several
months ago regarding whether a water damage bill from an HOA on decedent's
property incurred this July was reasonably ascertainable - thanks again for
those helpful responses. We filed notice to the creditor, and they filed
their claim 1 day past the creditor claims deadline.

The property has since been sold and the only lien on the property paid
off. This HOA claim was not secured. Our client also indicated that she
believes the HOA is going after the buyer for these charges.

Nevertheless, do unsecured HOA claims meet any exceptions under the
creditor claims rules? Or can we reject solely on the basis of lateness
without the possibility of the creditor petitioning and court accepting the
claim?

Best,

Suzanne Lieberman
