Listserve,

I am not experienced with life insurance and would like input on a COVID-related issue. Decedent was in the hospital with COVID (and died of it) for so long that his employer stopped paying premiums into his employer-sponsored life insurance policy that covered accidental death and dismemberment. The policy lapsed and then he died.

Is anyone aware whether an insurance policy would include a clause that would require the company to pay out? In other words, if the lapse was due to the illness that killed the person whose life was insured, perhaps there is an exception. Or is there anything Congress has passed regarding COVID that would override the policy?

I have not seen the policy in this case and plan to refer beneficiary to someone who might assist her (she cannot afford attorney fees). Self-referrals welcome.
