[WSBAPT] New death certificate law

I just tried to order death certificates online for a probate client this morning. When I selected “Legal Representative” as the basis for ordering the Long Form Certified Copy, VitalCheck/LexisNexis required me to give my full legal name and social security number. I had to pick what street I grew up on and what streets I did not live on. And then I had to upload a copy of the Court Order showing that I am the legal representative for the executor. And I am waiting to see if King County Public Health agrees that I have the right to buy the death certificate. What a pain! Now my paralegal can’t do this anymore since it needs my social security number and all of the streets I have ever lived on… Let’s see if this even works. Maybe we just have to have clients order it themselves and then give us a copy.

I had about 7 billable hours involved in getting a “presumed death by drowning” death certificate from the state and the coroner.  about 4 hours and dozens of calls and emails were involved with the DOH

Thanks, Dalynne. I checked the new WAC 246-491-010<https://apps.leg.wa.gov/wac/default.aspx?cite=246-491-010>, which provides (7) "Legal representative" means a licensed attorney representing either the subject of the record or qualified applicant. So it appears I can continue my standard practice of ordering copies of the death certificates if the client does not have it handy. I wonder if they will require any specific documentation that I represent the PR.

The new death certificate law went into effect Jan 1.  There is now an informational copy and then the certified copy.
In a recent probate, I received a court order to “correct” the person who reported was not a spouse although she reported on the death cert. that she was the spouse.
It was not easy and took 2 court orders and 3 tries to get it right with the WA State Dept of Health.

·         For increased security of personal information, only individuals with specific relationships to the person on the record being requested can receive a certified copy.
·         Identity and proof of relationship documentation will be required. Exact documentation is still to be determined.
·         Certificate fee will increase to $25.00 per copy.
