[WSBAPT] probate withdrawal

I'm reluctant as well but sometimes it's all I can do with a PR who won't cooperate, has fired me, or has stopped responding to communications or has simply disappeared. My position is that I give notice to my client, the PR, and then just file it in the probate matter. Unless I have an ongoing issue with someone in the probate, I don't serve it anywhere else.

If DOD was within 24 months and I'm still listed in published notices to receive claims, I usually just reconcile myself to possibly having to do a little bit more work without pay if a claim comes in. So far I haven't had to deal with such a claim (knock on wood).

Sincerely,

Eric

Subject: [WSBAPT] probate withdrawal

In the back of my mind, I have some reluctance to just file a withdrawal in a probate case in which we represent the PR. I don't know if we have to get court permission, or give notice to anyone other than the PR. what sayeth you?
