[WSBAPT] Non-probate for a not so small estate

I have a surviving spouse with 3 houses, all of which we are clearing up title with the use of a CPA and a affidavit to clear title non-probate.
She just received a $5000 reimbursement for assisted living home made out to husband.  The won’t cut a check to her unless letters Testamentary are issued or a small estate affidavit.  The three houses, even considering undivided one-half value are way over $100,000.

Anyone able to show authorities for making them re-issue check based on CPA?
