[Vision2020] Searching house by house in Boston

I can't figure out why a judge would think that the bomber wouldn't need to have his rights read to him, too. I can only assume it has something to do with the Patriot Act. They may indeed have set it up inadvertently to get this guy off. And if they had found him inside a house in which they didn't have a warrant to search, then they might be in trouble as well. The lesson, of course, is to play by the book, not run off half-cocked because they are looking for a terrorist.

I'm still puzzled why a judge ruled that is was OK not to read the bomber his Miranda rights. This could undo the whole case against him. This is a real question in this case since apparently information was elicited without the warning.
Is Gary's question hypothetical? Did someone actually refuse to allow a search? Either way, it is an important question. I am not a criminal and do not indulge in criminal activities. None-the-less, absent an extreme, extreme case, I would never consent to a warrantless search. I have a lot of private business that is no one else's save the transacting parties. Police discretion is not perfect, and in Idaho, very much less than perfect.
There is case law on searches during emergencies, but I've forgotten what it is. I don't have Lexus/Nexus, so I can't look it up easily.
