The problem could also be that the bar gets trashed and that innocent bystanders can be injured.  My point is that Tom doesn't understand first amendment rights / protections.  He'd likely face criminal and civil prosecution if he incited a riot and he'd not have a first amendment leg to stand on.  The backwards thinking is 'free speech' is 'get out of jail free card'.  It's not.

This situation is another example, by the way, of how we get this backwards.  The problem isn't saying "Fu*k you, nig*r!", the problem is that you might get physically assaulted for it.  The person (from Niger?) that assaults you for saying this is the one that has just crossed the line.
