The problem could also be that the bar gets trashed and that innocent bystanders can be injured. My point is that Tom doesn't understand first amendment rights / protections. He'd likely face criminal and civil prosecution if he incited a riot and he'd not have a first amendment leg to stand on. The backwards thinking is 'free speech' is 'get out of jail free card'.
