The Moscow Mayor, City Council and Staff welcome you to tonight's meeting.  We appreciate and encourage public participation.  For regular agenda items, an opportunity for public comment is sometimes provided after the staff report.  However, the formality of procedures varies with the purpose and subject of the agenda item; therefore, the Mayor may exercise discretion in deciding when to allow public comment during the course of the proceedings and limitations will be placed on the time allowed for comments.  Citizens wishing to comment on business which is not on the agenda will be provided the opportunity to do so as item number 3.  If you plan to address the Council, you will find a list of "Tips for Addressing the Council" on the table outside the City Council Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting one City Council member will present an example of patriotism, humanitarianism, community spirit, or other inspirational message then lead the group in the Pledge of Allegiance.  Contact a Council-member with examples to share at future meetings.

 

International Walk to School Day Proclamation - Mayor Chaney

 

1.       Consent Agenda:  Any item will be removed from the consent agenda at the request of any member of the Council and that item will be considered separately later.  Approval by roll call vote.

 

A.     Approval of Minutes of September 15, 2008 - Stephanie Kalasz

 

B.     Adams Lot Line Adjustment in Troutman Addition - Mike Ray

Don and Judy Adams are requesting a lot line adjustment for a 6,706 sq ft parcel of land currently addressed as 609 Homestead Street and legally described as Lot 2 Block 2 of the Trautman Addition to the City of Moscow.  The subject parcel currently has a two-family dwelling built on the property, is in the Medium-Density Residential (R-3) Zone, and is required by the Zoning Code to be a minimum of 7,000 sq ft in size.  Mr. and Mrs. Adams are requesting to amend the southern lot line of the parcel in order to add an additional 300 sq ft of area to their property.  The incorporation of 300 sq ft of the adjacent parcel would bring the subject parcel to 7,006 sq ft in size as shown on the attached map.  The subject parcel would then be in compliance with the City of Moscow Zoning Code, rendering it legally conforming.  Reviewed by the Public Works/Finance Committee on September 22, 2008.

 

ACTION:  Approve the lot line adjustment.

 

C.     PCEI Public Information and Education Contract - Tom Scallorn

Water conservation continues to be a very important and highly visible issue in the City of Moscow.  The City of Moscow wishes to continue its Community Based Public Information and Education Program (PIE) for Water Conservation.  The program will serve our customers in their homes, businesses, and the local schools and will address many of the Conservation needs of the community.  The current contract is a renewal of our PIE program that has been conducted by Palouse-Clearwater Environmental Institute (PCEI) for the past 4 years.  The current scope of work has been modified to enhance our conservation efforts with some modification.  Within the previous year, PCEI has been successful in producing newsletters, maintaining a presence in the local schools, and developing a comprehensive K-12 water conservation curriculum aligned with state and district standards.  Over 700 Moscow students learned about water conservation through the program last year.  PCEI also participated in many local events by setting up displays and providing conservation information at high visibility events such as the Home and Garden Expo and the Palouse Empire Mall's Earth Month.

 

ACTION:  Approve the Contract.

 

2.       Mayor's Appointments - Mayor Chaney

 

3.       Public Comment and Mayor's Response Period (limit 15 minutes)  - For members of the Public to speak to the Council regarding matters NOT on the Agenda and not currently pending before the Planning and Zoning Commission or Board of Adjustment, please state your name and address for the record and limit remarks to three minutes.  Mayor will respond to comments from previous meeting.  

 

4.       Request to Appeal Census Data - Bill Belknap

In June and July of 2007, the City was approached by two attorneys on behalf of their client Barry Tassler with a request that the City pursue an appeal to the Census Bureau's 2006 population estimate for the City of Moscow.  At that time the City declined to pursue the appeal.  The City has again been approached by Attorney Bob Tunnicliff on behalf of his client Barry Tassler with a request that the City pursue an appeal to the Census Bureau's recently published 2007 population estimate of 23,223 based upon their belief that the Census Bureau is underestimating the current population of Moscow.  Reviewed by the Public Works/Finance Committee on September 8, 2008.

 

ACTION:  Discuss and direct staff as deemed appropriate.

 

5.       Review of Alcohol License for Café Silos - Stephanie Kalasz/Randy Fife

The Silos made application to sell beer and wine for consumption on premises September 6, 2007.  Because the Silos Restaurant was located within three hundred feet (300') of the Impact Church, the Silos also sought a waiver of the prohibition for sales of alcohol within three hundred feet (300') of a school, church, or other place of worship.  The City granted a waiver of the prohibition to the Silos pursuant to MCC § 9-6-17(B) at a Council meeting held May 21, 2007.  The Silos has been operating pursuant to that waiver since May 21, 2007.  John Houser, the pastor of the Crossing Ministries (new owners of the building which previously housed the Impact Church) has objected to the license and requests that, prior to issuance of a beer and wine license in January of 2009, the Council reconsider its waiver.  Reviewed by the Administrative Committee on September 22, 2008.  

 

ACTION:  Receive input and review materials and give staff direction.

 

6.       Ordinance to Adjust Membership on Certain Commissions - Mayor Chaney/Randy Fife

The Ordinance adds to various Commissions (i.e., Parks and Recreation, Arts, Fair and Affordable Housing, Health and the Environment, Historic Preservation, Transportation, and Human Rights) the following:  at least one (1) student enrolled in at least 3/4 time in a post secondary educational program for a period of a renewable one (1) year term; at least one (1) student enrolled in high school or an equivalent educational program to serve as a non-voting ex officio member for a renewable one (1) year term; and at least one (1) Latah County resident who does not reside within City limits as a non-voting ex officio member of the Commission for a term equal to other members of the respective Commission.  It also designates a Council member as a non-voting ex officio member of the Human Rights Commission.  The purpose of this Ordinance is to bring a broader and, perhaps, different perspective to each of the foregoing Commissions, and to encourage the Mayor, City Council and Commissions to actively seek out those persons for inclusion on the Commissions who have the characteristics listed.  Additionally, the Ordinance proposes a change of name from the Commission on Health and the Environment to the Sustainable Environment Commission.

 

ACTION:  Approve the Ordinance under suspension of the rules requiring three complete and separate readings and that it be read by title and published by summary; or consider Ordinance on first reading and that it be read by title only; or reject the Ordinance; or take such other action deemed appropriate.




 

7.       Status of Joint Powers Agreement with Whitman County Concerning Provision of Water to Hawkins Stateline Project - Gary J. Riedner

On September 15, 2008, the Council was requested to provide staff direction in responding to Commissioner Largent's letter.  Direction was given and Riedner sent a letter on September 17, 2008 responding to Whitman Count's concerns.  On September 29, 2008, Commissioner Largent responded.

 

ACTION:  Direct staff to request a determination from IDWR in conformance with the attached memorandum or take such other action deemed appropriate.
