REGULAR MEETING


Monday, October 1, 2007
7:00 p.m.

The Moscow Mayor, City Council and Staff welcome you to tonight's
meeting.  We appreciate and encourage public participation.  For regular
agenda items, an opportunity for public comment is sometimes provided
after the staff report.  However, the formality of procedures varies
with the purpose and subject of the agenda item; therefore, the Mayor
may exercise discretion in deciding when to allow public comment during
the course of the proceedings and limitations will be placed on the time
allowed for comments.  Citizens wishing to comment on business which is
not on the agenda will be provided the opportunity to do so as item
number 3.  If you plan to address the Council, you will find a list of
"Tips for Addressing the Council" on the table outside the City Council
Chambers.  Thank you for your interest in City government.

 

RENEWING OUR FOCUS - At each meeting, one City Council member will
present an example of patriotism, humanitarianism, community spirit, or
other inspirational message.  Contact a Council-member with examples to
share at future meetings.

 

1.       Consent Agenda:  Any item will be removed from the consent
agenda at the request of any member of the Council and that item will be
considered separately later.  Approval by roll call vote.

 

A.     Approval of Minutes of September 17, 2007 - Stephanie Kalasz

 

B.     PBAC Interagency Agreement Addendum - Les MacDonald

The City of Moscow is one of seven entities that are participants in an
Interagency Agreement pertaining to the formation and operations of the
Palouse Basin Aquifer Committee.  As part of the ongoing efforts of PBAC
to provide research of the Palouse Basin Aquifer system, the City of
Moscow has been providing additional funding for a number of years.
This research funding is matched be similar contributions from the
University of Idaho, Washington State University and the City of
Pullman.  The PBAC representatives felt it is appropriate to modify the
Agreement to specify how the funding is to be utilized.  An Addendum to
the PBAC Interagency Agreement outlining the additional funding provided
by the four major pumping entities and describing how the expenditure of
these funds is to be determined is being proposed.  Reviewed by the
Public Works/Finance Committee on September 24, 2007.

 

ACTION:  Approve the Addendum to the PBAC Interagency Agreement to the
City Council.

 

C.     PCEI PIE Contract Renewal - Les MacDonald

The City of Moscow wishes to continue its Community Based Public
Information and Education Program (PIE) for Water Conservation. The
program will serve our customers in their homes, businesses, and the
local schools and will address many of the Conservation needs of the
community. The current contract is a renewal of our PIE Program that has
been conducted by Palouse-Clearwater Environmental Institute (PCEI) for
the past 3 years. The current scope of work has been modified to enhance
our conservation efforts. In the previous year, PCEI has been successful
in producing newsletters, maintaining a presence in the local schools,
and developing a comprehensive K-12 water conservation curriculum
aligned with state and district standards. PCEI also participated in
many local events by setting up displays and providing conservation
information at high visibility events such as the Home and Garden Expo
and the Palouse Empire Mall's Earth Month.  Reviewed by the Public
Works/Finance Committee on September 24, 2007. 

 

ACTION:  Approve contract for Professional Water Conservation Services
or take such other action deemed appropriate.

 

2.       Mayor's Appointments - Mayor Chaney

 

ACTION:  Approve appointment or take such other action deemed
appropriate.

 

3.       Public Comment and Mayor's Response Period (limit 15 minutes)
- For members of the Public to speak to the Council regarding matters
NOT on the Agenda and not currently pending before the Planning and
Zoning Commission or Board of Adjustment, please state your name and
address for the record and limit remarks to three minutes.  Mayor will
respond to comments from previous meeting.

 

4.       Request to Name Moscow Police Department Shooting Range in
Honor of Officer Lee Newbill - Chief Dan Weaver

Moscow Police Department employees would like to name the MPD Shooting
Range in honor of Officer Lee Newbill due to his work and commitment in
upgrading it to a first class range.  Reviewed by the Administrative
Committee on September 24, 2007.

 

ACTION:  Approve naming MPD Shooting Range in honor of Officer Lee
Newbill or take such other action deemed appropriate.

 

5.       Proposed Noise Ordinance Amendment - Chief Weaver

This would amend Moscow City Code Tile 10, Chapter 11 regarding the
Noise Ordinance Sec. 11.9.C.  The proposed changes will assist the
Police Department in addressing repeat offenders outside the current 48
hour warning period.  In addition, officers can use discretion at the
time contact is made with the responsible individual on the best process
for immediate cease all noise in excess of limits delineated by the
Ordinance.  The victim will no longer have to be contacted for charges
or sign a citation when the officers are called and observe the
violation.  The changes will directly impact boarding houses where large
groups of people assemble or known party houses with a history of public
nuisance complaints.  Reviewed by the Administrative Committee on
September 10, 2007.

 

ACTION:  Approve the Ordinance under suspension of the rules requiring
three complete and separate readings and that it be read and published
by title only; or consider the Ordinance on first reading; or reject the
Ordinance; or take such other action deemed appropriate.

 

6.       Tree Lawn Parking Ordinance - Les MacDonald

Over the last few years there has been an increase in the number
incidents noted by staff of the parking of vehicles on tree lawns and
public sidewalks.  This type of use of these areas is considered
detrimental as is precludes the use of the sidewalks for their intended
purpose and can cause damage to the tree lawn areas that are supposed to
support vegetation.  In order to allow for enhanced enforcement against
this detrimental activity the attached ordinance will add provisions to
the City Code Title 11 Chapter 4 that will prohibit the parking of
vehicles in the areas of the tree lawns and upon public sidewalks.
Reviewed by the Public Works/Finance Committee on September 24, 2007.
