1.      A. Public Comment and Chair's Response Period (limit 10 minutes)
- For members of the Public to speak to the Committee regarding matters
NOT on the Agenda and not currently pending before the Council, Planning
and Zoning Commission or Board of Adjustment, please state your name and
address for the record and limit remarks to three minutes.  

 

B. Approval of Minutes October 22, 2007 - Stephanie Kalasz

 

2.      Proposed Tree Commission Ordinance Amendment - Roger Blanchard

A recent review of the Moscow Tree Commission ordinance by the Moscow
Tree Commission and staff revealed certain inconsistencies in regard to
their duties and responsibilities and communications with other
commissions.  Commission members and staff worked with the City Attorney
to make changes to the ordinance that would clarify these
inconsistencies.  The proposed amendment has also been reviewed by Parks
and Recreation Department administration and the Health and Environment
Commission.

 

ACTION:  Recommend approval of the Ordinance amendment or take such
other action deemed appropriate.

 

3.      Transfer of Abandoned Bicycles to another Agency and Auction
items - David Duke

The Police Department requests the transfer of three abandoned bicycles
to the Drug and Mental Health Court program for their clients use as
well as approval of declaring the attached list of items as abandoned or
surplus property and the sale of one item ordered by the Court for
restitution.

 

ACTION:  Recommend approval transfer of three abandoned bicycles to the
Drug and Mental Health Court program as well as the list of items
attached as abandoned or surplus property and the sale of one item
ordered by the Court for restitution or take such other action deemed
appropriate.

 

4.      Heart of the Arts Major Renovation Proposal - Bill Belknap

Heart of the Arts Inc. (HAI), operating as the operator of the 1912
Center in accordance with the existing maintenance and operations
agreement, has developed a proposal to conduct a major operator
improvement to finish out the first level west wing portion of the
facility for use as public meeting space and an arts classroom/workshop.
The estimated cost of the project is approximately $200,000 and funding
would include the existing available $100,000 Murdock grant funds,
$4,000 from an existing grant from the Idaho Community Foundation,
$10,000 from an existing grant from the Idaho Commission on the Arts,
and a commitment from HAI to fundraise the remaining $86,000 for the
remainder of the project.

 

ACTION:  Recommend approval of the Major Renovation Proposal request; or
recommend denial of the request; or take such other action deemed
appropriate.

 

5.      Change for Sidewalks - Bill Lambert

Proposed fundraising program for sidewalks.

 

ACTION:  Discuss and direct staff as deemed appropriate.

 

 

6.      Withdrawal of Indian Hills 6th Rezone and Preliminary Plat -
Randy Fife

On October 15, 2007, City Council voted to approve the application for
rezoning of the Indian Hills 6th Addition but did not pass an ordinance.
Council directed staff to draft an ordinance based upon the motion
presented.  On November 1, 2007, Garrett A. Thompson presented a letter
to the City withdrawing the proposed rezoning and preliminary plat.  The
City Attorney was directed to research whether the City could continue
with its consideration of the proposed rezone in light of the
notification of withdrawal by applicant.

 

ACTION:   Receive information and direct staff as deemed appropriate.

 

7.      Discussion Regarding Unauthorized Weapons in Public Facilities -
Randy Fife

In response to concerns related to the presence of firearms, Randy Fife
wrote a letter to the Attorney General's office requesting an opinion
regarding the extent, if any, to which the City could regulate firearms.
The Attorney General responded in a letter dated September 18, 2007
stating that the City could not, on its own, regulate "ownership,
possession, or transportation" of firearms in the City.  Mayor Chaney
wrote a letter to the local State representatives regarding the matter
on October 29, 2007.  Shirley Ringo responded to the Mayor's letter on
November 5, 2007.

 

8.      Noise Ordinance Discussion - Dan Weaver/David Duke

Referred back to Committee by City Council at the November 5th, regular
City Council meeting.

 

ACTION:  Discuss and direct staff as deemed appropriate.

1.      Approval of Minutes October 22, 2007 - Stephanie Kalasz

 

2.      Disbursement Reports for September and October 2007 - Don Palmer

 

3.      Palouse River Drive Ball Fields Discussion - Dwight Curtis/Les
MacDonald

City Engineering recommends that a north/south road be constructed on
the eastern side of the park property located on West Palouse River
Drive.  This road would partially service any future expansion to the
south.  There are presently no south roads off of West Palouse River
Drive between the ball field property and Highway 95.  The Parks and
Recreation Staff, the Parks and Recreation Commission, and the Fields
Planning Committee request that the City Council authorize the planning
staff NOT to be required to construct this road through this property.
Parks and Recreation staff does not dispute the need for an orderly
connecting road expansion system, but requests an exception be made in
this case for the overall good of the intended use of this ball field
park.  

 

ACTION:  Recommend authorizing staff not to be required to construct a
north-south road through the West Palouse River Drive ball field park
property; or if the City Council decides to require the north-south road
across the property, recommend that it be located on the western
panhandle area so as not to interfere with the ball field site; or take
such other action deemed appropriate.

 

4.      Water Conservation Ordinance Changes - Les MacDonald

On October 15, 2007, the City Council considered proposed revisions to
the Water Conservation Ordinance that was adopted by the City Council on
May 17, 2004.  The revisions addressed the following areas:  Defining
the Outdoor Irrigation Season as the period within each calendar year
declared by the Public Works Director during which Outdoor Irrigation is
allowed within City limits which replaces the fixed season dates, the
beginning of the Outdoor Irrigation Season would be declared by May 1st
of each year; Specifying that Outdoor Irrigation shall be allowed only
between the hours of 6:00 p.m. and 10:00 a.m. during the Outdoor
Irrigation Season unless modified by variance; Prohibits Outdoor
Irrigation at all times not within the established Outdoor Irrigation
Season; and Prohibits watering of impervious surfaces.  The Council
considered the Ordinance on first reading and requested an additional
revision which would modify section 17-8 D to eliminate the two (2) hour
stipulation for restarting watering in violation of the code.   The new
draft of the ordinance, dated October 18, 2007 includes the requested
revision.

 

      ACTION:  Discuss and direct staff as deemed appropriate.

 

5.      3rd Street Bike-Pedestrian Bridge - Linda Pall

 

6.      CMAQ Grant - Les MacDonald/Alisa Stone

The Public Works Department is requesting approval to apply to the CMAQ
under the Capital Purchases Program for a Mechanical Broom Sweeper (MBS)
which uses brooms to lift larger coarse material to expedite fine
particle sweeping when used with a vacuum sweeper.  The MBS is estimated
by ITD to cost approximately $205,000.  The existing MBS in the City
Fleet was purchased in 1984 and was scheduled for replacement in 1999
but the City was unable to fund a new unit.  The City Fleet has a Vacuum
Sweeper (VS) which is used in conjunction with the MBS that was
purchased in 1999 and is not due for replacement until 2014.  The grant
application is due for review by the Idaho Department of Environmental
Quality (IDEQ) on December 5, 2007, and is then for final review to ITD
on January 16, 2007.

 

      ACTION:  Recommend approval of the grant application or take such
other action deemed appropriate.

 

7.      Change for Sidewalks - Bill Lambert

Proposed fundraising program for sidewalks.

 

ACTION:  Discuss and direct staff as deemed appropriate.

 

8.      Fairview Village Minor PUD Amendment Request - Bill Belknap

Good Samaritan Society has requested a minor PUD amendment to construct
a larger maintenance building than shown upon the approved PUD plans for
the Fairview Village Estates project located near the current northern
terminus of Fairview Drive.  The requested amendment would allow the
construction of an approximately 1,020 square foot maintenance building
rather than the approximately 240 square foot maintenance building that
was shown upon the approved PUD plans.  The Planning and Zoning
Commission reviewed the proposed minor PUD amendment and recommended
that the City Council approve the request.       

 

ACTION:  Recommend approval of the request or take such other action
deemed appropriate.
