Not having seen any examples of the communications in question, I am 
hesitant to concede your point. If Foleys e-mails ran down a laundry list of 
explicit sexual acts that he may have wanted to engage in then, perhaps, you 
are correct. If he invited the recipients to dinner and a movie followed by 
a friendly cuddle,  I'm afraid that the CDA would hardly apply. Don't get me 
wrong however, I'm off put by either but only one is illegal. The other is 
extremely poor judgment and lack of character.
