Like most of the material in the rest of his/hers posts, Kerry is totally in error in her/his assessment.
 
 
The process of granting the CUP to allow NSA (No Saints Around) to remain in the CBD is far from complete:
 
1.    The decision of the BOA is likely to be appealed to the entire city council on legal and other grounds.  Unlike the BOA and the inept Community Development Director, the city council is elected.  Therefore, they may take a much different view than the BOA about the effects on the entire city of granting the CUP.  They may take a much different view of the public policy ramifications of rewarding a serial zoning violator by legalizing the violator's crimes.  They may also take a much different view of the legal principles involved.
 
2.    The city council's decision can be appealed to district court.
 
3.    A district court decision can be appealed to the Idaho appellate courts.
 
4.    Idaho appellate court decisions can be appealed to the federal district court.
 
5.    Etc.
 
Who is going to pay for these appeals? The city? Nope, It's not in their budget. The people who don't like NSA is who. Don't waste your retirement money on fighting a good thing. It';; just give you ulcers.
