Unlike the BOA and the inept Community Development Director, the city council is elected. Therefore, they may take a much different view than the BOA about the effects on the entire city of granting the CUP. They may take a much different view of the public policy ramifications of rewarding a serial zoning violator by legalizing the violator's crimes. They may also take a much different view of the legal principles involved.</FONT></DIV>

<DIV><FONT size=4>2. The city council's decision can be appealed to district court.</FONT></DIV>
