1.      Consent Agenda:  Any item will be removed from the consent
agenda at the request of any Committee member and that item will be
considered separately later.
 
A.	Approval of Minutes of September 12, 2005 - Stephanie Kalasz 
 
B.	Receipt of P&Z Recommendation for Rezone at 122 and 204 S. Van
Buren and 504 & 510 Third St. - Andrew Ackerman
The property owners of four residential lots on the northeast corner of
Third Street and Van Buren have requested that their properties be
rezoned from Medium Density Residential Zoning District (R-3) to
Multiple Family Residential (R-4) Zoning District.  Idaho Code requires
that the governing body receive the Planning and Zoning Commission
recommendation on such applications prior to advertising a public
hearing by the governing body.  The Planning and Zoning Commission
conducted a public hearing and recommended denial of the subject rezone
application on August 24, 2005.  Staff intends to publish notice for a
Council hearing on October 17th, 2005.
 
ACTION:  Receive recommendation.
 
2.      Surplus Items for Fall Auction - David Duke 
Surplus items deemed unwarranted for retention and to consider an
alternative method to auction items over the internet.
 
      ACTION:  Recommend approval of surplus of items for fall auction
and select an auction process or take such other action deemed
appropriate.
 
3.      Agreement with ASCAP to Use Members' Copyrighted Musical Works -
Randy Fife
The City of Moscow has been contacted by the American Society of
Composers, Authors and Publishers (ASCAP) regarding the City's use of
copyrighted musical works in its functions. These uses are typically
through Arts and Parks and Recreational programs. ASCAP has worked with
the International Municipal Attorneys Association (IMLA) to author a
standard contract which grants the City use of the copyrighted materials
as defined in the Agreement for a period of one year for fee of $268.00.
This fee will recur on an annual basis.
 
ACTION:  Recommend approval of the agreement or take such other action
deemed appropriate.
 
4.   Amendment to Existing Animal Related Ordinances - Randy Fife
      A sub-committee of the Administrative Committee led by
Councilmember Dickinson met throughout the summer to review drafted City
ordinances related to animal care.  Attached are three proposed
ordinances:  (1) an Animal Care Ordinance which deals generally with
animals within City limits; (2) a Dangerous Dog Ordinance which deals
specifically with dogs which may be classified as dangerous and, after
such classification, establishes procedures and precautions to maintain
such a dog within the City; and (3) an Animal Care Commission Ordinance
which creates a commission to assist the City in education and promotion
of animal care matters and to act as an appeals board for decisions
which are related to animals and dangerous dogs.  These ordinances
represent a consensus of the sub-committee but do not reflect individual
opinions on certain matters under consideration.
 
      ACTION:  Review proposed Ordinances and direct staff as deemed
appropriate.

2.   Right-of-Way Vacation for the West 10 feet of Harrison - Dean Weyen

The owners of the property located on the west side of Harrison Street,
between Eighth Street and Lewis Street, have requested that ten feet of
right-of-way be vacated.  The franchise utilities have been notified of
this proposed right-of-way vacation request and their responses
regarding the existence of their facilities are attached for reference.
City Water, Sewer, and Streets Departments have also provided comments.
In 1987, the west ten feet of right-of-way on Harrison Street, between
Sixth Street and Eighth Street, was vacated to the property owners.  The
currently requested vacation is consistent with the vacation granted in
1987.  
 
ACTION:  Recommend approval of the vacation or take such other action
deemed appropriate.
 
3.   2925 Joseph Street Lot Division - Andrew Ackerman
Tod Gosselin has filed for a lot division to create two, approximately
0.5-acre lots from the existing two (2) acres of land on the south side
of Joseph Street (east edge of the city). The property was recently
rezoned on September 6, 2005 from Agriculture-Forest (AF) to Low Density
Single-Family Residential (R-1) Zoning District. The lot division
proposal meets code requirements for lot size, lot width and access for
both of the proposed lot configurations. The lot division is scheduled
as regular agenda item for the October 3rd, 2005 Council meeting.
 
ACTION:  Recommend approval of the lot division or take such other
action deemed appropriate.
 
4.   Fiber Optics Bid Award - Bill Belknap
City staff has been working with various public entities including the
Moscow School District, Gritman Medical Center, the University of Idaho
and the State of Idaho Transportation Department in planning for the
construction of a public entity fiber optic network intended to allow
the participating entities to interconnect their respective facilities.
One element of this project is the extension of fiber optic cables to
the City's and Moscow School District's facilities located in the
east-side of the City which has been named the East Side Fiber Optics
Project.  The cost of the project was estimated at $125,000 with the
City's portion representing approximately $65,000 of the total.  Two
bids on the project were received, one from North Sky Communications and
one from Sefnco Communications in the amounts of $157,182.42 and
$178,405.00 respectively.  Upon examination of the bid responses North
Sky's bid has been determined to be non-responsive as they failed to
acknowledge the two bid document addendums published during the bid
period.  Therefore we have only one responsive bid in the amount of
$178,405.00.  Staff is recommending to award the Bid to Sefnco
Communications and to execute a concurrent change order to make
modifications to the project.  
 
      ACTION:  Recommend awarding bid to Sefnco Communications and
execute a concurrent change order to make modifications to the project.
