The Moscow Mayor and City Council welcomes you to tonight's meeting.  We
appreciate and encourage public participation.  For regular agenda items, an
opportunity for public comment may be provided after the staff report.
However, the formality of procedures varies with the purpose and subject of
the agenda item; therefore, the Mayor may exercise discretion in deciding
when to allow public comment during the course of the proceedings and
limitations will be placed on the time allowed for comments.  Citizens
wishing to comment on business which is not on the agenda will be provided
the opportunity to do so as item number 2 after the Consent Agenda.  If you
plan to address the Council, you will find a list of "Tips for Addressing
the Council" on the table outside the City Council Chambers.  Thank you for
your interest in City government.

at the request of any Councilmember and that item will be considered
separately later.  Approval by roll call vote.

C.         Sanitary Pipe Lining - 2004 Bid Award - Les MacDonald

On August 5, 2004, two bids were opened for the sanitary sewer pipe in 'E'
Street between Cleveland and Garfield.  Planned Engineering Construction,
Inc. of Helena, Montana was the low bidder at $50,666.00; the other bid was
$59,520.00.  Reviewed by the Public Works/Finance Committee on August 9,
2004.

 

ACTION:  Accept the low bid and award of the Sanitary Pipe Lining contract
to Planned Engineering Construction, Inc. of Helena, Montana.   




D.        Agreement with Dept. of Commerce for Downtown CDBG - Bill Belknap

The City of Moscow applied for and was subsequently awarded a State of Idaho
Community Development Block Grant (CDBG) in the amount of $500,000 to assist
in the revitalization of Friendship Square and other improvements within the
downtown area.  In order to receive those funds, the Department of Commerce
has provided the standard Community Development Block Grant Contract
specifying the grant amount, allowable uses and reporting requirements.
Reviewed by the Public Works/Finance Committee on August 9, 2004.

 

ACTION:  Approve the Community Development Block Grant contract.

 

E.         Community Forestry Grant and Community Transportation Enhancement
Grant Authorization - Roger Blanchard

Staff is requesting to apply for a Community Forestry Grant and a Community
Transportation Enhancement Grant from the Idaho Department of Lands.  The
Community Forestry Grant would be used to fund the purchase of new GIS
compatible street tree inventory software and the Community Transportation
Enhancement Grant would be used to fund the installation of landscaping
adjacent to a section of paradise from Mountain View Road to where the
pavement currently ends west of Carmichael road.  Reviewed by the
Administrative Committee on August 9, 2004.

 

                        ACTION:  Approve application for a Community
Forestry Grant and a Transportation Enhancement Grant.

 

F.         Revocation of Alcohol License - Gary J. Riedner

The State of Idaho and Latah County have revoked their Beer and Wine
Licenses for Jesse Johnson dba The Edge (The Beach).  Since State and County
licenses are required as conditions for a City Beer and Wine License, the
City Clerk and City Attorney recommend revocation of the City license.
Reviewed by the Administrative Committee on August 9, 2004.

 

ACTION:  Revoke the Beer and Wine License for Jesse Johnson dba The Edge
(The Beach).

 

G.         Audit Management Response - Don Palmer

            Each year, when the audit has been completed, the auditing firm
makes recommendations for improving the City's financial procedures.  This
year three recommendations were proposed.  Reviewed by the Public
Works/Finance Committee on August 9, 2004.

 

            ACTION:  Accept the City of Moscow Management Response Letter.

 

2.         Public Comment Period - For members of the Public to speak to the
Council regarding matters NOT on the Agenda and not currently pending before
the Planning and Zoning Commission or Board of Adjustment, please state your
name and address for the record and limit remarks to three minutes.  Time
limit 15 minutes.

 

3.         Public Hearing - FY2005 Budget - Don Palmer

In a budget workshop on July 19, 2004, the City Council heard the Mayor's
proposed balanced budget for fiscal year 2005.  After deliberation, City
Council approved the proposed budget with changes totaling $365,000 as
outlined in the accompanying memo.  In addition, it is necessary to allocate
funds to carry over from FY2004 to FY2005 to complete approved projects.

 

ACTION:  After considering public testimony, approve the annual
Appropriation Ordinance under suspension of the rules requiring three
complete and separate readings and that it be read by title only; or take
such other action deemed appropriate.

 

4.         Open Budget - Don Palmer

The State of Idaho allows cities to amend their original appropriation
ordinance in accordance with Title 50-1002 of the Idaho Code.  Staff is
proposing to amend Ordinance 2003-22 because of unallocated fund balance
carryover from the Fire Station project and unexpected and unallocated
revenues.  All of the revenue changes and appropriation uses total
$2,115,275 as noted in the accompanying memo.  Reviewed by the Public
Works/Finance Committee on August 9, 2004.

 

ACTION:  Adopt the Amended Appropriation Ordinance under suspension of the
rules requiring three complete and separate readings and that it be read by
title only; or take such other action deemed appropriate.

 

5.         School District's Bus Garage and Storage Facility Complex
Driveway Relocation/Dog Park Modifications Briefing - Les MacDonald

As part of the development of the design of the improvements for the
Southgate Addition Phase 1 Subdivision the applicant approached the City
about the potential for encroaching upon the City's Dog Park located on
White Avenue for the reconstruction of the access road to the Moscow School
District's Bus Garage and Storage Facility.  Staff has worked with the
applicant and the District to determine what type of mitigation would be
reasonable for the proposed impact to the City's facility.  A preliminary
mitigation concept plan has been developed and is attached for reference.
During the meeting a presentation will be given outlining the components of
the proposed plan. An estimate of the cost of the mitigation has been
prepared and is also attached.  Reviewed by the Public Works/Finance
Committee on July 26 and August 9, 2004.

 

            ACTION:  Approve the proposed bus barn driveway encroachment
into the Dog Park property with the associated mitigation and direct staff
to facilitate the implementation of the mitigation including measures for
the transfer of properties between the City and the School District; or take
such other action deemed appropriate.

 

6.         Changes to the Beer, Wine and Liquor License Ordinances - Gary J.
Riedner

Historically, the City Council has annually approved each beer, wine and
liquor license submitted to the City.  In an effort to increase efficiency
and streamlining administrative processes, changes to the ordinances are
proposed delegating these ministerial approvals to staff.  Reviewed by the
Administrative Committee on August 9, 2004.

 

ACTION:  Approve the Ordinance making changes to the Beer, Wine and Liquor
Licenses under suspension of the rules requiring three complete and separate
readings and that it be read by title only; or reject the Ordinance; or take
such other action deemed appropriate.

 

7.         September Meeting Schedule - Gary J. Riedner

            Since the next scheduled Council meeting falls on Labor Day,
staff recommends rescheduling the September 6th Council meeting to Tuesday,
September 7th.

 

            ACTION:  Change the date of the first Council meeting in
September from the 6th to the 7th or take such other action deemed
appropriate.
