We'll formally present the motions on today's call, but in brief response I would say that yes, our intent is to only present motions that mirror the motions voted on and passed by the Subcommittee.  So, no, we will not be making a formal motion on the Assignment of Benefits Bill today.

I will also be circulating the Agenda for the call in a few minutes, which will include the call-in information.  I've also received some direction from Katherine Frazier on what the Section will need for them to take action, and I'll discuss that on today's call.

I may or may not be able to make the call this afternoon, so wanted to add my comments and votes if necessary:

  1.  I support the action of the subcommittee and if there is a motion that mirrors those actions I would vote in favor of that motion. If it is separated by bill, I would support the subcommittees action on each bill subject to item #2 below. In other words, if neither item in #2 occurs, then I support the subcommittee recommendation.
  2.  If there is a motion to oppose SB 122 (the Assignment of Benefits Bill - on which the committee took no action) I would vote in favor of that motion. If there is a motion to support SB 122, I would vote against that motion. If this is going to be referred to the CLC and its legislative subcommittee, that need to happen quickly. There have been some emails about it but no formal action taken at this point. We have been rather pre-occupied in recent weeks by another insurer/surety effort to make payment bond claims substantially more difficult and complex (SB1200/HB1247).

Folks,

On behalf of the Insurance & Surety Committee, I wanted to inform you all that we are calling a special meeting of the Committee tomorrow afternoon at 3:00 PM (Eastern).  We will be using the regular call-in line and passcode, which are provided below.  The purpose will be to review certain Bills currently before the Florida Legislature pertaining to insurance that our Legislative Subcommittee has reviewed and voted to recommend to the Section that it take certain action on them.  Tomorrow morning, I will forward an Agenda, but attached are the Bills and corresponding committee papers that we will cover (e.g., HB 301, SB 714, and HB 751).  Any Committee member interested is welcome and encouraged to call in.  For your reference of the Motions that will be before the Committee tomorrow, attached are the Subcommittee's Meeting Minutes from the 2 legislative review meetings that were held last week.  Please review the Motions discussed in each of the Minutes, as those will be the basis for the Motions made on tomorrow's call.
