Trespass is an in personam action. Thus, the neighbor would only have a
viable cause of action against the tenant who is allegedly trespassing. The
suit would presumably be for an injunction and for damages in the amount of
the fair rental value of the parking area allegedly occupied by the
trespasser.

Subject: [RPPTL Leasing Committee] Landlord Guilty of "Constructive"
Trespass

A landlord client with commercial property has an adjoining neighbor (AN)
that is threatening to sue my client because the AN claims my client's
tenants are illegally parking on AN's property. My client is not parking,
using, etc. AN's property. None of AN's claims are true, but . . .

Can my landlord client be sued for anything here? Is there a claim such as
"constructive trespass" or "conspiracy to trespass"?
