Manny,

I think it would be a civil trespass action, but if I’m not mistaken that requires a showing of damages. Not sure if he can prove any damages other than a nominal amount for the deprivation of the space. I think injunctive relief would be more appropriate, but also hard for the AN to recover fees unless property is part of an HOA.

Subject: [RPPTL Leasing Committee] Landlord Guilty of "Constructive" Trespass

A landlord client with commercial property has an adjoining neighbor (AN) that is threatening to sue my client because the AN claims my client’s tenants are illegally parking on AN’s property. My client is not parking, using, etc. AN’s property. None of AN’s claims are true, but . . .
Can my landlord client be sued for anything here? Is there a claim such as “constructive trespass” or “conspiracy to trespass”?
