Did the problem study committee take a look at how other states are
addressing E-Signing commercial leases/waiving witness requirements?
Tenants are often dealing with out-of-state companies who own property
within the state. While out-of-state landlords often hire local counsel to
negotiate the lease, sometimes landlords like to use their own proprietary
forms. If other states are moving towards allowing electronic signatures,
it would be a good idea to address this issue in Florida sooner rather than
later.
Also, many real estate transaction management software companies are
equipped with the software to conduct electronic signatures in compliance
with UETA/Esign Act. If the technology is in place to ensure signatures are
tracked, I think moving forward with legislation to support electronic
transactions is appropriate.
