I may be on the call late as I have a conference call at 11 that will likely run long.  However, I have updated the Construction Transactions Subcommittee case update to add the Gallo case.

The addition is mostly to raise a practice tip to require that the owner shall be a third-party beneficiary of the subcontracts.  Gallo is an insurance case that determined the subcontractor’s insured had a duty to defend the allegations brought by its general contractor for construction defects.  The report is attached.  The case has a good discussion of coverage under the specific allegations in the complaint, notwithstanding the “Your Work” exclusion and the stucco v. EIFS exclusions.
