<i>Gallo</i> case. <o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:11.0pt;color:#1F497D">The addition is mostly to raise a practice tip to require that the owner shall be a third-party beneficiary of the subcontracts. Gallo is an insurance case that determined the subcontractor’s
insured had a duty to defend the allegations brought by its general contractor for construction defects. The report is attached. The case has a good discussion of coverage under the specific allegations in the complaint, notwithstanding the “Your Work” exclusion
and the stucco v. EIFS exclusions.<o:p></o:p></span></p>
