[WSBARP] Different Legal Description

Anybody else have any input on this one?

The consensus seems to be to go judicial foreclosure instead of nonjudicial and to seek a reformation of the deed of trust correcting the legal description. If so, does anyone have any templates for such an action/motion that I could use?

Hi ListMates,

I’m working on a nonjudicial foreclosure of one unit in a 3 unit building that was converted to condo under a Declaration in 2022. I recently noticed that the DOT we are foreclosing on was recorded subsequently in 2023 using the pre-condo legal description but acknowledges the correct parcel no. and unit number.

Do you foresee any issues with moving forward as is, or does it appear that I’m attempting to foreclose on the entire building?
