In your foreclosure documents describe the unit number or letter the recording number of the declaration and the survey map, the tax parcel number for the unit together with whatever percentage interest that unit has in the common elements that way you're simply foreclosing on the unit and its interest in the common elements not on the totality of the condominium property

Subject: Re: [WSBARP] Different Legal Description
Hi ListMates,
I'm working on a nonjudicial foreclosure of one unit in a 3 unit building that was converted to condo under a Declaration in 2022. I recently noticed that the DOT we are foreclosing on was recorded subsequently in 2023 using the pre-condo legal description but acknowledges the correct parcel no. and unit number.
Do you foresee any issues with moving forward as is, or does it appear that I'm attempting to foreclose on the entire building?
Thanks.
