[WSBARP] Condo gurus

Listmates.  We have  a parcel of land that various people wish to divide up and add to their existing lots. The County has denied their application for a reason not applicable to this question so we are forming a small condo project so each party gets exclusive use and ownership of the piece they want.    The RCW has language requiring a certain percentage affirmative vote to amend the condo or terminate it.    The parties would like the unilateral right to withdraw from the condo if and when the county will allow the BLA.  Everyone is in agreement with this  provision but it is contrary to the statutory language.   Can unilateral withdrawal at the withdrawing units expense be agreed to in the Declaration or is that a violation of public policy and cannot be waived? Your thoughts are appreciated.
