Have you contacted the underwriter? First, they should endorse the policy with the correct information.

Keep in mind that when making a claim under the policy the insured must show a financial loss or a monetary claim being made the property.  I had a situation a few years ago where the underwriter missed a recorded sewer agreement that when a homeowner connects to the city sewer system, they had to pay $30,000. My client had a septic tank and when he wanted to add a bathroom, the city obligated him to connect to the sewer and cough up $30K. We submitted a claim to the underwriter, and they paid, because my client showed he was going to suffer a loss.

Subject: [WSBARP] Referral for a claim against Title Co., King County

PC purchased vacant land with entitlement to a shared well.  The Title Report shows a well agreement, but not the correct well agreement, despite there being a recorded document for the correct well.  I'm looking for a referral for a claim on the title insurance related to the purchaser now having a different water situation than they expected.
