[WSBARP] Attorney fee recovery

Listmates,  Looking for a theory to recover attorney fees in a case where the claims are based on common grantor, easement by implication or prescriptive easement.   The client want to have a reasonable shot at recovering attorney fees before proceeding.   No contract language to fall back on.   Thanks in advance!!
