[WSBARP] Danger (maybe) trees

Hi all

 

Client has a couple of maybe dead or dying trees on his rural and unimproved
property. Neighbor who just bought expensive adjacent house wants the trees
removed because they might fall over onto his expensive house. Neighbor has
a tree service who gave an opinion that the trees are hazardous, and
neighbor's insurance guy is apparently telling him that my guy's insurance
won't cover a downed damage-causing tree because my client supposedly has
foreknowledge of the alleged dangerous condition. 

 

I think this is more of a tort question than a property one, but has anybody
run into something like this before, and how was it resolved (if it was)?
