Listmates, I have a client who, without understanding the implications,
added his minor son to title. He then sold the property, and the title
company failed to identify the earlier deed. So the minor retains an
interest, and the buyer is demanding a clear tittle. The title insurer
believes a GAL must be appointed for the minor, who can then reconvey the
child's interest.
This is beyond my scope of practice. Is there anyone here on the list who
handles guardianship cases, or whatever sort of case this might be? Please
let me know.
Thank you!
Craig
