As some of you may know, I have been litigating with a company called Ten Bridges for a few years. Part of Ten Bridges' business was purchasing the right to receive surplus proceeds from judicial foreclosure sales for pennies on the dollar. In Ten Bridges, LLC v. Guandai, 15 Wn. App.2d 223, 474 P.3d 1060 (2020), Division One of the COA held that RCW 63.29.350, which was part of Washington's version of the Uniform Unclaimed Property Act, made it illegal for companies like Ten Bridges from purchasing unsuspecting former homeowners' rights to receive surplus proceeds if the company that was to receive the cash equity received more than 5% of the available surplus proceeds. The COA invalidated one former homeowner's assignment of the right to receive ~$85,000 for only $15,000, and invalidated another former homeowner's assignment of the right to receive ~$346,000 in exchange for Ten Bridges' promise to pay her $172,000 from the "first" money it received due to the assignment.

The 2022 legislature did a routine update of the Uniform Unclaimed Property Act and in doing so, inadvertently repealed RCW 63.29.350 without a savings clause or enacting a comparable statute. People whose cases were already pending at the time of the effective date of the repeal no longer can rely on RCW 63.29.350 to invalidate transactions that were entered into while the statute was in effect. Rep. Orwall introduced legislation this year that would fix the inadvertent repeal of RCW 63.29.350 and make its former provisions apply under the new law to persons who had entered into such illegal transactions before the repeal, as well as to persons who in the future enter into such transactions. The proposed Act, SHB 1637, passed out of the Judiciary Committee with no opposition. But now it's stuck in the Rules Committee, and the last day for full House floor votes is tomorrow. It is URGENT that everything that can be done is done to move the Bill out of Rules Committee.

Therefore, I request and urge you to call House Speaker Laurie Jinkins today, as soon as you can, to urge her to do everything in her power to move SHB 1637 out of the Rules Committee so it can have a full floor vote. Her office telephone number is 360.786.7930.
