A new subdivision is in the approval process under RCW 58.17.  Is there a
requirement that the final plat reference that the new association will be
governed under RCW 64.90?  I did not see anything requiring that in 58.17,
but that is one question.

 

Second, does RCW 64.90 require the association be formally formed with the
Secretary of State before the first lot is sold?  Again, in looking at the
statute, I did not see that specific requirement.  Your thoughts.
